Terms and Conditions of ONLINE sales

Please read these terms and conditions (“these Terms”) carefully before confirming your purchase on the Your Office Choice online store. Your order is placed on the understanding that you have read, understood and agreed to these Terms.

PURCHASING ONLINE

Product colours, appearance, feel of your item can differ on your computer/laptop/tablet or handheld mobile device screens to how they appear in reality. Please choose carefully as you may not be able to obtain a refund in this instance. Our accessories in print/website/television or any other media or advertising are for display purposes only. Our display accessories shown in photographs are not included in prices quoted. You confirming you have read these Terms is confirmation of your agreement that your goods are purchased on this understanding.

YOUR ORDER

  • You may only place an order if you are over the age of 18 and resident in Australia. By placing an order, you confirm that this is the case.
  • If you place an order for someone else to receive the goods, you must obtain their consent before providing their personal information and, by placing an order, you confirm that you have done so.
  • Please ensure you enter all information carefully when placing an order. You warrant to us that all information provided by you in relation to your order is complete, true and accurate.
  • An order submitted by you is an offer by you to purchase the goods for the price plus the applicable delivery fee as shown in the shopping cart. Your Office Choice may accept or reject your offer in its absolute discretion.
  • Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), Your Office Choice will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a result of your order information (such as the delivery address) being incomplete or inaccurate or as a result of you being unable to change or cancel your order once Your Office Choice has accepted your order.
  • Unless you agree otherwise with Your Office Choice, where you place separate orders, the goods will be delivered separately and a separate delivery fee will apply to each order.
  • Where you order more than one item in one order, all goods for which your order is accepted at the same time will generally be despatched together in one package.

DELIVERY

  • Your Office Choice agree to deliver goods to you on the understanding reasonable access is available. If reasonable access is unavailable or you are not at delivery address at the agreed delivery time you will be charged for any subsequent delivery.
  • On delivery, inspect your goods carefully. Any damage detected should be immediately reported to the carrier and Your Office Choice as noted on the delivery copy. Once you have inspected your goods and have signed their acceptance on the delivery copy noting any damage, you agree that the delivery copy is then evidence of the condition of the goods as at the time of delivery.
  • Items labelled RTA (ready to assemble) will require self assembly.
  • Unless otherwise agreed with Your Office Choice, disposal of packaging is your responsibility.

RETURNS POLICY

At Office Choice, we are trusted for value and we make doing business easy. If you are unhappy or don’t see value in the goods that you have purchased, it’s important that we know. We’ll do what we can to make sure that you have the right experience. Our returns policy is as follows:

Defective Goods

Where you consider a product is defective or fails to be of acceptable quality, Your Office Choice will endeavour to have the goods repaired or replaced, or a refund issued. They may need to send the product to the manufacturer’s repair agent to determine the nature and severity of the issue. In the case of neglect or misuse of the product, a repair, replacement or refund may not be progressed.

Please be aware that data (including, but not limited to, images, music and video) may be lost during the repair process of electronic products. It is your responsibility to ensure that all such data is backed up.

Change of Mind Returns

It’s important to us that you have the right product to suit your needs. When it can, Your Office Choice will exchange your item or offer a credit. Change of mind returns will not be redeemed for cash.

To make a change of mind return:

  • Present your item to Your Office Choice in a new, or ‘as-new’ resalable condition (complete in original packaging);
  • Return the item to your Assigned Store: within 7 days of delivery receipt for technology, business machines or furniture, and; within 14 days of delivery receipt for all other items; and
  • Present your original proof of purchase.

Our change of mind returns do not apply to:

  • Computer Hardware & IT Consumables (including Ink & Toner) unless in original packaging and unopened;
  • Food Consumables;
  • Gift Cards; and
  • Customised or Special-Order items.

Please note that for change of mind returns a restocking or return fee may be charged. This fee will be deducted from the refund of money you have already paid. This fee reflects our reasonable costs.

Australian Consumer Law (ACL)

Your rights listed above are in addition to, and do not in any way limit, your rights under the ACL. In the case where a product is faulty, is not of acceptable quality, or the product is not fit for its intended purpose, please refer to the ACL for your additional rights.

OTHER TERMS

  • All goods are advertised in good faith. A failure by the manufacturer/supplier to deliver in accordance with sample, description or at all, may result in some goods being unavailable.
  • If for any reason your Assigned Store is unable to supply the goods moneys paid will be refunded to you.
  • We reserve the right to correct errors and misprints and to change product specifications.
  • We reserve the right to cancel any order without limitation. In this event a full refund will be paid.
  • Our RRP is the manufacturer/provider’s RRP or, where RRP is unavailable, the price is set by us at a reasonable estimate of the market price.
  • To the fullest extent permitted by law, including the ACL, the following provisions apply:
    1. a. Your Office Choice does not warrant the accuracy of any product safety information (including any Safety Guide) or product care information provided with your goods or which you may access through our website and such content is provided to you on condition that you undertake all responsibility for assessing the accuracy and suitability of such content and rely on it at your own risk; and
    2. b. Your Office Choice does not have any responsibility or liability in relation to any loss or damage that you incur (including to property or person) arising from your use of your purchased goods or your reliance on any product safety information (including any Safety Guide) or product care information provided with your goods or which you may access through our website and you release Your Office Choice from any such claim, damage or loss except to the extent that any such claim, damage or loss is caused or contributed to by the negligence of Your Office Choice.

    Proceeding with your order shows confirmation of your agreement that your goods are purchased on the above basis.

DIRECT MARKETING

Like most businesses, marketing is important to our continued success. We believe we have a unique range of products and services that we provide to customers at a high standard. We therefore like to stay in touch with customers and let them know about new opportunities. We may provide you with information about new products, services and promotions either from us, your Assigned Store or from other third parties which may be of interest to you. We will disclose your personal information to your Assigned Store so that your Assigned Store can process your order. We will not disclose your personal information to other third parties for marketing purposes without first notifying you. You may opt out at any time if you no longer wish to receive commercial messages from us. eDM disclaimer

All products in this communication were available at the time of sale. Stores that only range limited stock may have a different but comparable product available. Failure of supplier delivery or other unforeseen circumstances could result in some items not being available. Display accessories are not included in any price. All products and prices in this communication were correct at time of eDM dispatch. We reserve the right to correct errors and to change product specifications.
